{"id":223,"date":"2015-06-08T17:32:55","date_gmt":"2015-06-08T21:32:55","guid":{"rendered":"http:\/\/judgejordan.com\/judgeblog\/?p=223"},"modified":"2015-06-08T17:35:21","modified_gmt":"2015-06-08T21:35:21","slug":"small-estate-affidavit","status":"publish","type":"post","link":"https:\/\/judgejordan.com\/judgeblog\/small-estate-affidavit\/","title":{"rendered":"Small Estate Affidavit &#8211; ?"},"content":{"rendered":"<p><a href=\"http:\/\/judgejordan.com\/judgeblog\/wp-content\/uploads\/2015\/06\/oath_150.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-224 alignleft\" src=\"http:\/\/judgejordan.com\/judgeblog\/wp-content\/uploads\/2015\/06\/oath_150.jpg\" alt=\"oath_150\" width=\"150\" height=\"105\" \/><\/a>June 8, 2015. \u00a0Often one reads about a &#8220;Small Estate Affidavit.&#8221; \u00a0What is it? \u00a0What is the purpose of the document? \u00a0Is it filed? \u00a0Where is the form? \u00a0Etc., etc.<\/p>\n<p>Actually, we do not have a &#8220;small estate affidavit&#8221; here in Georgia as an official form to be filed in the Probate Court. \u00a0Other States may have court procedures for estates under a certain amount, but we do not have such a procedure here (although there are some other procedures for estates with little assets).<\/p>\n<p>OK, so there is no form, there is nothing to file in Probate Court, is there any help?<\/p>\n<p>There is a statute which gives some relief if there is money in the bank or other depositary institution of a relatively small amount, and certain other conditions apply.<\/p>\n<p>As of the date of this post, Official Code of Georgia Annotated, Section 7-1-239, reads as follows. \u00a0The &#8220;affidavit&#8221; is mentioned in the last paragraph. \u00a0Again, there is no official form. \u00a0Perhaps the particular bank will have its own affidavit form. \u00a0Of course, an &#8220;affidavit&#8221; means that the document is signed under oath.<\/p>\n<div>\n<div class=\"co_documentHead\">\n<div class=\"co_cites\">Ga. Code Ann., \u00a7 <span id=\"co_term_289\" class=\"co_searchTerm\">7<\/span>&#8211;<span id=\"co_term_290\" class=\"co_searchTerm\">1<\/span>&#8211;<span id=\"co_term_291\" class=\"co_searchTerm\">239<\/span><\/div>\n<div class=\"co_title\">\n<div id=\"co_anchor_I9D550D70658B11DEAE0DC80CD1FBA08E\" class=\"co_headtext\"><strong>\u00a7 <span id=\"co_term_339\" class=\"co_searchTerm\">7<\/span>&#8211;<span id=\"co_term_340\" class=\"co_searchTerm\">1<\/span>&#8211;<span id=\"co_term_341\" class=\"co_searchTerm\">239<\/span>. Payment of deposit of deceased depositor<\/strong><\/div>\n<\/div>\n<div class=\"co_currentness\">Currentness<\/div>\n<\/div>\n<div id=\"co_anchor_I9D544A20658B11DEAE0DC80CD1FBA08E\" class=\"co_contentBlock co_section\">\n<div class=\"co_contentBlock co_body\">\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D550D71658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\">(a) Except as provided in subsection (b) of this Code section and in Article 8 of this chapter, whenever any person dies intestate having a deposit of not more than $10,000.00 in a financial institution, such financial institution shall be authorized to pay the proceeds of such deposit directly to the following persons:<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\" style=\"padding-left: 30px;\">\n<div id=\"co_anchor_I9D553480658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\" style=\"padding-left: 30px;\">\n<div class=\"co_paragraphText co_indentLeft1\" style=\"padding-left: 30px;\">(1) To the surviving spouse;<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\" style=\"padding-left: 30px;\">\n<div id=\"co_anchor_I9D553481658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\" style=\"padding-left: 30px;\">\n<div class=\"co_paragraphText co_indentLeft1\" style=\"padding-left: 30px;\">(2) If no surviving spouse, to the children pro rata;<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\" style=\"padding-left: 30px;\">\n<div id=\"co_anchor_I9D553482658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\" style=\"padding-left: 30px;\">\n<div class=\"co_paragraphText co_indentLeft1\" style=\"padding-left: 30px;\">(3) If no children or surviving spouse, to the father and mother pro rata; or<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\" style=\"padding-left: 30px;\">\n<div id=\"co_anchor_I9D555B90658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\" style=\"padding-left: 30px;\">\n<div class=\"co_paragraphText co_indentLeft1\" style=\"padding-left: 30px;\">(4) If none of the above, then to the brothers and sisters of the decedent pro rata.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D555B91658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\"><\/div>\n<div class=\"co_paragraphText\">(b) Except as provided in Article 8 of this chapter, if no application for the deposit is made by any person named in subsection (a) of this Code section within 90 days from the death of the intestate depositor, the financial institution shall be authorized to apply not more than $10,000.00 of the deposit of such deceased depositor in payment of the funeral expenses and expenses of the last illness of such deceased depositor upon the receipt of itemized statements of such expenses and the affidavit of the providers of such services that the itemized statements are true and correct and have not been paid. The financial institution shall pay such expenses in the order received after the death of the depositor.<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D555B92658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\"><\/div>\n<div class=\"co_paragraphText\">(c) Payments pursuant to subsections (a) and (b) of this Code section shall operate as a complete acquittal and discharge to the financial institution of liability from any suit, claim, or demand of whatever nature by any heir, distributee, creditor of the decedent, or any other person. Such payment is authorized to be made as provided in this Code section without the necessity of administration of the estate of the decedent or without the necessity of obtaining an order that no administration is necessary.<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D5582A0658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\"><\/div>\n<div class=\"co_paragraphText\">(d) In any case in which a deceased depositor has more than $10,000.00 on deposit in a financial institution, such financial institution shall be authorized to pay any amount up to $10,000.00 to any of the persons authorized by this Code section to receive said deposit. The payment shall only act as a full and final acquittance of liability up to the amount paid by the financial institution and shall not act as a full and final acquittance to the financial institution of all liability.<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D5582A1658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\"><\/div>\n<div class=\"co_paragraphText\">(e) Notwithstanding any other provisions of law to the contrary, when any person dies intestate as a resident of this state and any person is left in possession of moneys belonging to the decedent, which moneys do not exceed $10,000.00, such person shall deposit such moneys into a savings account in the name of the decedent in a financial institution located in the area of the decedent&#8217;s residence. Such account shall be managed in accordance with the signature contract in effect at the financial institution at the time the account is opened. Any financial institution receiving such deposits is authorized to pay the proceeds in accordance with subsections (a), (b), (c), and (d) of this Code section.<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D5582A2658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\"><\/div>\n<div class=\"co_paragraphText\">(f) As used in this Code section, the term \u201cfinancial institution\u201d includes any federally chartered financial institution.<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_I9D55A9B0658B11DEAE0DC80CD1FBA08E\" class=\"co_paragraph\">\n<div class=\"co_paragraphText\"><\/div>\n<div class=\"co_paragraphText\">(g) Application by any claimant or claimants entitled in this Code section to receive deposits at a financial institution shall include an affidavit by the claimant or claimants which states that they qualify as the proper relation to the decedent as specified in this Code section and that the claimant or claimants know of no other corresponding claimant or claimants to such deposit. The financial institution may rely on a properly executed affidavit in disbursing the funds according to this Code section.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"copyWithRefReference\">Ga.
