{"id":230,"date":"2015-06-09T10:17:35","date_gmt":"2015-06-09T14:17:35","guid":{"rendered":"http:\/\/judgejordan.com\/judgeblog\/?p=230"},"modified":"2015-07-27T10:17:50","modified_gmt":"2015-07-27T14:17:50","slug":"all-pop-had-was-an-old-car","status":"publish","type":"post","link":"https:\/\/judgejordan.com\/judgeblog\/all-pop-had-was-an-old-car\/","title":{"rendered":"All Pop Had Was An Old Car"},"content":{"rendered":"<p><a href=\"http:\/\/judgejordan.com\/judgeblog\/wp-content\/uploads\/2015\/06\/car_300.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" size-medium wp-image-228 alignleft\" src=\"http:\/\/judgejordan.com\/judgeblog\/wp-content\/uploads\/2015\/06\/car_300-300x198.jpg\" alt=\"car_300\" width=\"300\" height=\"198\" \/><\/a>June 9, 2015. \u00a0Occasionally, a deceased person will leave minimal property. \u00a0Perhaps a small bank account &#8211; and a car. \u00a0And that&#8217;s about it.<\/p>\n<p>I have already discussed the possibilities with regard to the small bank account. \u00a0<a href=\"http:\/\/judgejordan.com\/judgeblog\/?p=223\" target=\"_blank\">You can read that post here<\/a>. \u00a0What about the vehicle?<\/p>\n<p>If certain conditions are met, one may be able to transfer the title to the vehicle without going through any procedure in Probate Court. \u00a0There is an official form which you can download from this site, valid as of the date of this post. \u00a0I will post the link shortly.<\/p>\n<p>Note that this process requires an affidavit &#8211; a document under oath &#8211; which states many facts. The operative facts in the form are:<\/p>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>&#8220;&#8230;who at the time of his or her death was the owner of the motor vehicle described below, <strong><span style=\"text-decoration: underline;\">left no will<\/span>; <span style=\"text-decoration: underline;\">no application for the administration<\/span> <\/strong>of the estate of the deceased is to be had; the estate is <strong><span style=\"text-decoration: underline;\">not indebted<\/span><\/strong>; and the surviving spouse, if any, and the heirs, if any, have <strong><span style=\"text-decoration: underline;\">amicably agreed<\/span><\/strong> among themselves upon a division of the estate that the certificate of title for said vehicle be issued to the person named below.&#8221; \u00a0(Emphasis Supplied) \u00a0(I will have another post soon about what &#8220;heirs&#8221; are.)<\/p>\n<p>I have underlined certain parts of the above language because all of those facts must be present. \u00a0Note also that a copy of any will not probated must be attached (see the bottom of the form.) \u00a0Other documents must be attached also.<\/p>\n<p>Please note also that if a person leaves a will, but it is not going to be probated, it still must be filed with the Probate Court in the county of residence of the deceased. \u00a0A petition to probate the will is not required; however, the will must be filed. \u00a0Note also that a will does not have any effect whatsoever until it is probated, that is, admitted to probate by the Probate Judge after a proper petition to probate is filed.<\/p>\n<p><a href=\"http:\/\/judgejordan.com\/judgeblog\/wp-content\/uploads\/2015\/06\/MV_Inheritance_Affidavit_Form_T20_0.pdf\">Click Here for the Vehicle Title Affidavit<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>June 9, 2015. \u00a0Occasionally, a deceased person will leave minimal property. \u00a0Perhaps a small bank account &#8211; and a car. \u00a0And that&#8217;s about it.
